Acting as counsel for the organization that presents Peter Nero and the Philly Pops, Archer & Greiner P.C. has helped the one-of-a-kind orchestra attain the financial resources and administrative support it needs for the upcoming 2011-12 season of performances.
Archer & Greiner represents Encore Series Inc. (ESI), the nonprofit organization that operates the Pops, led by legendary conductor Peter Nero. The firm negotiated an agreement under which the Philadelphia Orchestra Association (POA) will provide $1.25 million to help fund the Pops’ upcoming season. Under the court-approved agreement, POA will also provide administrative support through next summer, including personnel, office space and business equipment. After that, the six-year affiliation between the two orchestras will end.
The agreement was approved by the Honorable Eric L. Frank, Judge of the U.S. Bankruptcy Court for the Eastern District of Pennsylvania, where both orchestras have filed for voluntary Chapter 11 bankruptcy reorganization. Leaders of both organizations have described the agreement as an amicable parting of ways that will help both orchestras achieve financial stability while continuing the outstanding musical performances for which they have become famous.
Archer & Greiner’s team of attorneys on the ESI matter is led by Stephen M. Packman, Chair of the Firm’s Bankruptcy Practice Group. Mr. Packman and his colleagues are working closely with ESI leaders to craft a reorganization plan to present to the Court, one that will achieve long-term viability for the Pops to the benefit of the orchestra’s legion of fans.

Archer’s attorneys got up to speed immediately and have worked with unwavering diligence despite ESI’s current financial challenges.”
