FOR IMMEDIATE RELEASE
(Free-Press-Release.com) April 4, 2010 --
Adrienne Dunn and her co-counsel, both Dallas Criminal Defense Lawyers in Dallas were in charge of Cecil Keith Hayes Federal Appeal.
Hayes was convicted in one robbery in June 2002. In jury selection, prosecutors removed all but two blacks. The jury imposed a 10-year prison sentence.
After a carefull and thorough review of the previous trials, Adrienne Dunn and her co-counsel focused their Federal Appeal on two excluded black jurors who were replaced by two white jurors with the same characteristics resulting in an all-white jury during the trial.
The 5th U.S. Circuit Court of Appeals Judges KING, STEWARD and HAYNES concluded that the judge during the trial illegally struck the two black jurors, refering to the landmark Batson vs. Kentucky, 476 U.S. 79 (1986) case.
Adrienne Dunn said that she hopes the reversal demonstrates a sea change in judicial attitudes toward the bar on jury discrimination.
