With sadness A M Benjamin Services acknowledges first round defeat in a legal
battle against a dental HMO.

A M Benjamin Services was suing the dental HMO for:
1. False Advertising
2. Medical Malpractice
3. Insurance Bad Faith
4. Intentional infliction of emotion distress.

Thou we had documents and court cases to make you think
the dental HMO had violated several legal rules, the arbitrator
of the case seen things different and ruled against us.

At first I was devastated because I really needed the win for confidence,
but later I realized that a bigger issue was at stake, and that it was the thousands
of employees who worked for the organization I do and is subjected to the same
unfair acts I was.

The primary reason I filed the lawsuit against Liberty Dental Plan was because
the two times I went to see dentist in the HMO network, both times I was told by their
insurance sales clerk that the price chart for my plan was meaningless and the
only way I could be treated is if I paid market rate for their dental services.

After going thru a multi phase appeals process, the case finally ended in arbitration,
but the arbitrator felt my case against Liberty Dental Plan was weak.

Thou losing the case, in many way I feel like a winner.

The reasons I feel like a winner is because:
1. I forced Liberty Dental to give me a hearing after they first ignore my request for arbitration
2. I have the right to ask for an appeal in state court which will make my complaint
a public record.
3. I learnt the procedures that needs to be taken when getting treated by dentist.

From the beginning of my case, I knew the arbitrators had a bias against me because of the tone
of their voices when they spoke with me.

The first arbitrator of the case died before the ended, the second arbitrator talked to me like I was an
moron and did many things that made think she was having private conversation with the opposing
parties, a violation of legal code of ethics.

What is Pro Se Litigation ?

Pro Se Litigation is when an individual tries to represent themselves in civil court.

The right to self representation is a right guaranteed to by both state and federal courts.

While it would great to have an experienced lawyer represent you in court, to many lawyer
do not care about justice, to many lawyers only care about money and their personal biases.
