AT&T, Verizon et al File Motion to Dismiss in the GDRI – Max Davis Antitrust Proposed Class Action

Los Angeles, California, United States of America (Free-Press-Release.com) November 9, 2011 -- On November 07, 2011, a motion to dismiss was filed by the Defendants in the antitrust and unfair competition lawsuit against AT&T, Verizon, Sprint, T-Mobile USA and TracFone (wireless carriers). The lawsuit is (#11-02674 DDP) and a link to the MTD appears below.

Max Davis, the founder of two non-profit organizations that have been advocating for cooperation from the wireless carriers and government in dealing with these mobile peer to peer file-sharing issues said today, “In a time of visible discontent about the way large corporations marginalize everyday people just to increase their corporate profit margins, you would think AT&T and the others would get it. Over the years we’ve shown them the many benefits to facing up to their legal and social responsibility to the creators of the content on their mobile file-sharing systems. By enabling the creators of content to monetize the sharing of that content, the wireless carriers could put themselves, creators AND consumers in a position for long term growth and innovation in these areas and yet the wireless carriers continue to look the other way as if these new distribution methods which draw from others’ copyrighted works should be exclusively for their benefit.”

He goes on to say, “These are serious issues that can make or break a creator’s ability to reclaim reasonable value for the fixed medium of expression. Why in the world would the wireless carriers be against this? The excuse in the past may have been that they weren’t aware of the negative issues associated with unbridled file-sharing. But after a number of lawsuits about these issues, that excuse is no longer legit. Makes you wonder doesn’t it? I wish there was some sort of tangible leadership within the Occupy Wall Street - America movement, for this would make one more excellent and very productive focal point to back in the war on corporate greed.”

A hearing for the motion to dismiss has been set for 10am, January 9, 2012 in courtroom 3 (Spring St.) in the Central District of California - the honorable Judge Dean Pregerson presiding.
