Atty Robert J. Wishart - "Violator of Decency"

of the firm (Wishart, Norris, Henninger & Pittman, PA) has been recognized by the Legal Justice Corporation as a
“VIOLATOR of DECENCY”.

When Robert J. Wishart, (a managing partner or the Wishart, Norris, Henninger & Pittman law firm) was notified that employee Attorney Steven B. Ockerman erred when preparing a Court Order for an uncontested child support matter, he refused to have the matter corrected. A simple fifteen minute correction in an uncontested child support matter has turned into a five year battle and a potentially fifteen million dollar suit. In a nutshell, one line of the Court Order stated child support was to be received at the rate of $150 every other week. The next line said the amount was to be taken out via payroll deduction at $300 per month. You do not need to be a math major to realize that $150 every two weeks does NOT equal $300 per month. The signed Court Order was clearly in conflict with itself and was not enforceable by the Courts. Not a single payment had been made nor received in over three years. Dispute continued for almost a year between client and attorney. Letters of complaint were sent to every practicing member of the Wishart, Norris, Henninger & Pittman law firm and NO ONE took action. Steven Ockerman (nor ANYONE from the Wishart, Norris, Henninger & Pittman, PA law firm located at 6832 Morrison Blvd. in Charlotte, NC) was willing to correct the rather obvious mistake. Instead, Mr. Ockerman cowardly withdrew from the case. When the Judge asked Mr. Ockerman in Court (at the Withdrawal Hearing) if he wanted to “correct his mistake”, he simply replied – “No, Your Honor, I am all done with this case”, and cowardly walked away.
When Mr. Wishart was made aware of the situation, he too chose to ignore the error and place blame on the client. He sent a rather nasty letter to the client. The letter, dated September 10, 2007 follows.

Dear Client:
Maria has asked me to review your memo of August 21, 2007 with the lengthy and sometimes defamatory attachment. Frankly I have little patience with someone who feels communication with venom and sarcasm is an effective way to discuss issues which should be addressed civilly and maturely. That said, I will respond to you anyway.

Nevertheless, and principally because we would prefer never to hear from you again, I am enclosing a check for $900.00. This represents the present value of the $1,350 which you contend you have or will overpay because of the bi-weekly schedule. As you know, $1,350 spread out over 52 months is not equal to $1,350 when reduced to present value. Please recognize that this payment of $900.00 is not predicated on my belief that you are entitled to it. I simply feel that it’s a relatively small price to pay to help assure that we never have to hear from you or of you again.

The letter clearly shows Mr. Wishart to be a sarcastic, pompous, bully attorney. Mr. Wishart is/was the President of the Alamance County Bar Association of North Carolina. This certainly does not say much for the Bar Association to let this type of attitude and these bullying ways dominate the top level of hierarchy of this group. Is it no wonder the citizens of Alamance County, the State of North Carolina, and the entire United States are fed up with the “legal system” … and lack thereof. Is it no wonder why “attorneys” have such a bad reputation and are considered to the scourge of the earth by many educated men and women? Too many attorneys believe they are above the laws of civilization and more importantly … the laws of decency.
Apparently, Mr. Wishart thought the client would eventually go away … just like the others before him. Apparently, Mr. Wishart was wrong … again. The Legal Justice Corporation was set up to expose attorneys just like Robert J. Wishart for who they are and the values they represent.
