Why did BofA keep issuing billions in mortgage backed securities, backed by sub prime mortgages even though they themselves stopped issuing them 10 years earlier? Were they hiding derogatory information from their investors about these loans in violation of SEC required disclosures? Bof A has already set aside $4 Billion to buy back some of these fraudulent securities but their liability, as may be disclosed by WikiLeaks could make this a drop in the bucket.

Missing documentation of mortgages B of A supposedly owns. This alone could bring the house down, pun intended. During the housing bubble, B of A and the other major mortgage issuing banks, played fast and footloose with real estate ownership regulations that were hundreds of years old. Instead of paying the fees and registering their mortgages with the County Clerks in the counties the properties were located in, admittedly a painfully slow process, the Go Go Boys came up with their own method of keeping track of who own what mortgage as they were sliced and diced into securities. They called this the MERS system, Mortgage Electronic Registration System. MERS may have well tracked who owned what to the satisfaction of the banks, but sice MERS never bothered to register the underlying mortgages with the appropriate County Clerks, Millions of mortgages were never registered as local law required. This not only invalidates the foreclosures of these properties by Bof A, it also potentially obviates the legal validity of every mortgage on B of A's books that was not properly recorded.

There are other irregularities that BofA committed that will be outed by the well placed BofA whistle blower, the toxic mess of fraud and corruption inside of Countrywide Mortgage, which BofA bought during the crisis with help from the Government, has already generated thousands of law suits, which could be increased exponentially and tipped in the favor of the homeowner by the insider information.

There is also the issue of whether the bank and Merrill Lynch conspired together to time their government aided shotgun merger to get the taxpayer funds to pay the billions in bonuses to Merill executives right after the merger was approved.
