Bio3 Research has submitted to EPO observations concerning the patentability of Creabilis Therapeutics EP 1919979

Bio3 Research S.r.l., Milan – Italy, has submitted to the European Patent Office observations pursuant to Art. 115 EPC concerning the patentability of the invention claimed in Creabilis Therapeutics EP 060777076, filed on 25.08.2006, publication number

(Free-Press-Release.com) July 22, 2011 -- June 30th 2011 - Bio3 Research S.r.l., Milan – Italy, has submitted to the European Patent Office observations pursuant to Art. 115 EPC concerning the patentability of the invention claimed in Creabilis Therapeutics EP 060777076, filed on 25.08.2006, publication number EP 1919979 “Polymer Conjugates of K-252A and Derivatives Thereof”.

Bio3 Research S.r.l. has drawn the EPO examining division‘s attention to the content of Bio3 Research patent EP 1368060 granted by EPO on May 19th 2010, which discloses the therapeutic use of HMGB1 antagonists in the treatment of cardiovascular affections, stenosis, restenosis, atherosclerosis, vasculitis and other pathologies of connective tissues.

Bio3 Research S.r.l. believes that its granted patent EP 1368060 affects the inventive step of the subject-matter claimed in the Creabilis Therapeutics application EP 1919979.

Bio3 Research S.r.l. in view of the observations filed, believes that the HMGB1 antagonists claimed by Creabilis Therapeutics in the application EP 1919979, which refers to the same pathologies claimed by Bio3 Research S.r.l. in its already granted patent EP 1368060, does not meet the requirement of inventive step under Art 56 EPC and therefore EP 1919979 should not be accordingly patented.

Bio3 Research S.r.l. will purse all the available options to safeguard its Intellectual Property rights including, if necessary, to challenge the potential patent infringement in all the appropriate juridical courts.

Bio3 Research S.r.l. patent EP 1368060 has already been granted in: Europe, USA, Mexico, Australia and it is pending (very final phase) in Canada, Japan and China.
