BSA rules against TV3 – TV3 is fined and censured.

(Free-Press-Release.com) July 14, 2011 -- On 31 March 2011 the New Zealand Broadcasting Standards Authority in decision number 2010-064 upheld a complaint lodged on behalf of Tony Katavich by William Akel of Simpson Grierson. The complaint centered around broadcasts on TV3′s Campbell Live program on 3, 4 and 5 March 2010. The program broadcast allegations of a very serious nature against Mr Katavich.

The BSA decision issued today found that TV3 breached the fairness provision of the Broadcasting Act, and that “Campbell Live treated Mr Katavich unfairly by implying he was a criminal and a fraudster”, “TV3 appears to have no evidence to that effect”. The BSA ordered TV3 to pay Mr Katavich legal costs of $2000. The BSA found that imposing this penalty would be a “justified and reasonable limit on [TV3's] freedom of expression”. They also concluded that the fine and censure was appropriate given the allegations made.

Mr Katavich again calls on TV3 to formally retract the allegations and apologise for, and make good the damage caused to his reputation and that of his company. He notes that over a year has elapsed since the serious allegations were aired, and there has been no contact whatsoever from any New Zealand authorities such as the Police, the Commerce Commission, nor indeed the Cyber Fraud Unit that TV3 urged viewers to make complaints to.
