Atlanta -- Free-Press-Release.com-- Jul 25, 2011 -- The most bizarre political event in our nations history has come to a conclusion, and the laws passed are as sloppy as any ever conceived. Lawmakers had "no idea what this is" in Wisconsin. Authors of these laws don't know what they include, police with warrants, "contraband" and suspect present are leaving arrests up to the DA's office in Utah because they too do not understand these laws.These laws were often passed as an "emergency action" the new buzzword for "I have no idea what I am voting for". It has happened in at least 36 states. Bad laws aimed at controlling specific compounds, bundling very dangerous substances with relativley benign ones. In the past, every law of this type has failed, every single time, but that did not deter any of these states from passing laws that are dangerous and irresponsible to their citizens.
States such as Wisconsin, Texas, Colorado, North Carolina and many more have passed strict laws targeting so called synthetic cannabinoids that are common ingredients in herbal incense products as well as many common products you may not suspect. These laws have failed, without exception, every time they have been passed. The issue here is simple, lawmakers have no clue what this issue is all about, they are told it is to protect teenagers, they are told the compounds are dangerous, they are told of tragedy and suffering...they are not told the truth.
The DEA Drug Fact Sheet states "There have been no reported deaths by overdose." yet there are many news reports that attempt to associate a persons behavior with these compounds, typically the author tries to associate Cannabinoid products with Bath Salt products, which is like comparing a go cart to a Maserati. The bath salts are DANGEROUS substances and have been verified to cause deaths in people, so called synthetic cannabinoids have no such track record in spite of 50 years of their use. There have been no reports of any widespread medical problem, only single isolated incidents. There has been no report of any long term effects. It is absolutely true that K2 and Spice products are "safer than peanuts" as was steted on ABC's 20/20 (coincidentally, ABC news was running pop up ads for Spice on thier news page during the airing of their program that appeared to be against the products)
This misinformation by many sources is part of a broad scale campaign to stop the off label use of the products that contain these ingredients. The National Conference of State Legislatures (NCSL) has been drafting legislation based on DEA recommendations they say, however testimony given to the Senate International Drug Caucus on April 6th 2011 was indicating that the DEA position was one against the use of chemical specific bans to deal with this rising issue. "Manufacturers and distributors will continue to stay one step ahead of any state or Federal drug-specific banning
or control action by introducing/repackaging new cannabinoid products that are not controlled." This position was echoed by other agents in the field. The DEA clearly is against any type of chemical specific ban because the number of compounds is vast, there are thousands of them, and they are not at all like THC, one of the active ingredients in Natural Cannabis. The NCSL believes they are like THC, this is incorrect, and therefore the sample legislation they put forth is unenforceable, misguided and riddled with Fourteenth Amendment violations. The NCSL is where states get draft legislation on topics they know nothing about, relying on this organization for facts and truth to get the laws passed.
Dan Francis, Executive Director of the Retail Compliance Association ( RCA ), says " Bans are dangerous, they send the products underground, there really is nothing more irresponsible a lawmaker can do but to wash their hands of this issue and hand the drug cartels another five billion in business" Francis warns against bans " Texas will see soon, as we are getting reports now, of kidnappings, armed robberies and the like, crime never previously associated with Herbal Incense products, as cartels work to gain product and market control ahead of September first, the date their cannabinoid ban goes into effect, they should repeal it immediately, it actually bans Tylenol, or AM404, the synthetic cannabinoid responsible for all of Tylenol's pain relieving effects". The RCA supports regulatory measures and age limits for purchase as opposed to legal bans on these products.
"There are a new types of compounds that are not cannabinoids taking to the market now" says Francis." Lawmakers cannot control this with legislation, they will simply make fools of themselves, again. If the market is interrupted in any single state, it is just a matter of a short time until replacement products will be available, all cannabinoid free, all legal"
