Dallas Law Firm Chamblee, Ryan, Kershaw & Anderson Wins Take-Nothing Defense Verdict in $1 Million Medical Malpractice Case

DALLAS – The Dallas law firm Chamblee, Ryan, Kershaw & Anderson, P.C., is announcing a take-nothing defense win in a $1 million medical malpractice case filed by the family of a 40-year-old man from Mesquite, Texas, who died from an invasive staph infection.
The victory is one of several recent take-nothing verdicts obtained for clients by Chamblee Ryan, including numerous successful negotiations and courtroom decisions obtained for doctors and other health care providers in medical malpractice claims.
The firm’s latest successful verdict was won on behalf of a Garland, Texas-based general practitioner. The physician treated a boil on a patient’s scalp that was infected with Methicillin-resistant Staphylococcus aureus (MRSA). According to the American Hospital Association, MRSA kills tens of thousands of people each year.
The physician treated the infection with antibiotics in February 2009, but the patient died two months later from staph pneumonia and sepsis resulting from an MRSA infection. The man’s family responded with a lawsuit claiming the physician was responsible.
Dallas trial attorney Jeffery M. Kershaw, a name partner at Chamblee Ryan, represented the physician during trial. Mr. Kershaw explained to jurors how the physician successfully treated the first onset of MRSA before the patient succumbed to the second, fatal infection.
“Our key witness was the medical examiner, who said there were no signs of infection existing on the patient’s scalp,” says Mr. Kershaw. “Further, we produced an infectious-disease specialist who stated that you don’t die one month later from the same MRSA infection. He was outstanding. He went toe-to-toe with the plaintiffs’ attorney.”
The verdict was handed down by a Dallas jury following a five-day trial. Mr. Kershaw regularly represents physicians in variety of legal matters, including particular expertise in medical malpractice claims.
