Well, presently in India there is no comprehensive guideline or regulations for day care center in Bangalore however, there are certain constitutional norms which can be utilized to tame uncontrolled growth and substandard day care center in many cities in India like Bangalore, Mumbai, Delhi etc.

In India also there are certain provisions scattered in different statues like Child Labour Prohibition Act, Indian Penal Code, Constitution of India etc. However, it cannot be said that they are exhaustive and specific dealing with the issue directly. Indian laws do not define what constitutes daycare. It does not even specify details of the physical facilities (washroom, eating, sleeping, lighting levels, etc.). However laws in some of the nations like Australia are very exhaustive dealing with almost all issues and aspect. For example in Australia, law mandates staffing ratios of 1:3 for under 16–18 months, 1:5 for 18–30 months, 1:8 for over 30 months, and even higher ratios for older children. However in some states this ration is less. For example, within the US: Pennsylvania, ages 1–3, 1 teacher to 5 children;[10] Missouri: age 2, 1 teacher to 8 children; North Carolina: 1 teacher to 10 children.
Therefore, India needs a comprehensive legislation dealing with these issues. As the problem of child care is going to big in coming days owing to fast and busy lifestyle, work pressure and lack of time with parents. Obviously parents will resort to these uncontrolled day care center. Therefore to ensure that India’s future is in safe hand and they are groomed properly we need some guidelines and standards so that a proper upbringing can be given to tiny toddlers. Therefore, in my opinion the model legislation should cover following points.

This should include building safety guidelines like measure on star case, limitation on height, hygiene, room ventilation etc.
Study hour
Supreme Court in Bandhua Mukti Morcha case had given guidelines on study hours like 2 hour of daily study and then breaks so all these should be embodied in the model legislation as well so that we can improve the standards of day care center.
Mandatory registration

It should be made mandatory that all existing day care center as well as new one going to be set up should register their existence and get permission from government then only they should be allowed to run and government should also ensure that they do not give permission to any body without properly verifying the facilities and compliance of safety standards.
