California Delivery Drivers / Couriers - Are you aware of your rights under California Labor Law? Did you know that you may be owed more money from the company that you work for?
Common Violations of California Labor Law Relating to Delivery Drivers / Couriers:
- Some companies purposefully Misclassify their drivers / couriers as "Independent Contractors" to avoid paying overtime, providing meal and rest breaks, contributing payroll taxes, providing workers compensation, etc.
- Some companies will not pay minimum wage and "allow" drivers / couriers to keep a delivery charge and tips as the only form of compensation. This may be a violation of minimum wage violations.
- Many delivery drivers / couriers are not reimbursed for expenses relating to using their own vehicles for making deliveries for the company including: Mileage Reimbursement, Car Insurance, Maintenance, Gas. Other required reimbursement may include Cell Phones, Maps, Flash Lights, Batteries, etc.
- Some drivers / couriers are required to work a morning shift and then come back to work following an extended break to work an evening shift. This split-shift interval may need to be compensated.
- Lack of proper wage statements. Many delivery drivers / couriers are not provided proper wage statements (pay stubs) attached to their pay-check (if any) according to California Labor Law.
These are just a few examples of California Labor Law violations that may be encountered by delivery drivers / couriers in California.
