When a business decides to play music on their telephone on-hold system or add it to content in its products they should be aware that they require clearance from the owners of the music. Large penalties can be applied for non-compliance. One should also think of Wedding Videos, Concerts that take place in schools and any type of event that includes music; this applies to background and mood music. It has to be said that in many cases it is simply due to ignorance of the legality applied to music licensing. The belief that they have bought a legal copy of a CD or DVD off the web or in a shop is sufficient is simply false.

In fact the majority of companies today, which can consist of large as well as small and includes banks and building societies use music simply with the intention of giving their callers something to listen to whilst they are placed on hold. There are a multitude of companies that play music during the day to their employees in workshops and other production environments. Yes all this sounds very innocent but there is a price to pay for non compliance.

Created in Jan 2009 the PRS (Performing Right Society) for Music in conjunction with MCPS (Mechanical-Copyright Protection Society) being a non-profit organization created to increase the likelihood of composers, publishers and songwriters being paid the royalties they are due whenever their music is played back. This obviously applies to live performances, to TV and Radio. Most important too is that Duplicators and manufacturers of CD & DVD Duplication , CD & DVD Replication must have a copy of the licence agreement before they can begin the ‘copying’. Streaming and downloads must also have a license.

The possibility exists to register works and also to become a member of PRS music through their website where creating an on-line account is very easy to conclude. With amendments being added and registered within the customer account page. If for any reason one finds any difficulty or requires advice, there is a comprehensive help centre. The actual cost of the license will naturally depend on various factors which include the size and type of premises, the extent of how much the music is to be played, also the nature of the music is relevant. So far several hundred thousand businesses in the UK comply having purchased their licenses. Naturally, for medical organisations like hospitals and day centres, certain ceremonies and divine worship are exempt.

With more than forty different tariffs, covering everything from music in stores to on-hold telephone systems. It has to be agreed charging by use is a fairer charging system. With tariffs paid according to size and type of enterprise and property, it will involve private business, and government organizations, educational establishments and so on. It has to include the extent to which the music is played. With royalties split between the writers and publishers according to the publishing agreement. There are cases when no payment is applicable, this applies to small groups and bands who simply hand out a certain amount of copies of their albums free of charge, nevertheless, you have to obtain a license.

Writers of music as yet unpublished or music that has been published by non members of PRS are responsible for registering the music and applying any amendments, it is also own to publishers with already published music to ensure it is carried out on behalf of their writers. Music that is co-written and co-published is the responsibility of all participants.

Happily for the songwriter, composer or publisher, when a piece of music is registered, it will afford them the opportunity to begin earning money whenever it is played. This includes the use on radio, TV programmes or advertisements, festivals, concerts and including whenever business play their music in a way ascribed previously. For more comprehensive information and support why not access the PRS website. For any new songwriters and publishers and businesses that are considering using or indeed are using music without a license, they would be advised to contact PRS for Music Directly.

Anybody requiring music copying from manufacturers or duplication facilities of CD or DVD must be wary that unfortunately, unscrupulous suppliers do exist who are more than willing to provide the duplication without the required licensing. Anybody that proceeds in this manner must expect to be prosecuted and receive a heavy fine and confiscation of equipment.
