July 2, 2011, New York, NY: End Discrimination Now came out swinging at the "astonishingly" amateur handling of the Rape case filed by a Guniean immigrant against the powerful and deep pocketed IMF chief Strauss Kahn. The Wall Street Journal ran a large picture of a smiling Defendant leaving New York Criminal Courrt after Judge Michael Obus loosened restrictions on his bail. Apparently, the Judge panicked after the Defense team, predictably, found inconsistencies in the woman's recounting of her behavior after the alleged attack and "misstatements" in her asylum application. Before the Prosecution had even completed its case and clearly before expert testimony was given ADA Joan Iluzzi Orbon told the press "It is clear that the strength of the case has been affected by the substantial credibility issues relating to the complaining witness". Apparently this was in response to Defense attorneys threatening to release damaging information to the press. This statement came despite the Prosecution having hard physicial evidence of sexual assault including vaginal bruising taken at the hospital, evidence of Strauss Kahn's DNA in the room and proof he left the room "so quickly he still had toothpaste on his face".
END President Kathryn Jordan characterized the Prosecutor's "panic attack" as "shockingly unprofessional" and disloyal to the victim. 'ALL women are protected under the Laws of New York State against rape and violent sexual assault.

The behavior of the victim after the assualt is "completely consistent" with a trauma victim. Given that there was physical evidence this was a strong case, especially given Mr. Struass Kahn's history". Jordan harshly criticized the DA's office for failing to present expert testimony on the 'imperfect victim' standard and studies on the behavior of rape and DV victims after physical violation and abuse. END also slammed the Defense attorneys for blackmailing Prosecutors and using the media to "try the case" and possibly even lying to them about alleged 'evidence" that would "gravely undermine the credibility of the case". Jordan said the woman's concocting a story about her husband being beaten and tortured, and herself gang raped to gain asylum in the US was "troubling" and "should never have been admitted". The immigrant also fabricated facts on her Tax Returns to get 'deductions". "This kind of willful act to me would be more relevant than the woman's behavior under stress". However, Jordan said that the woman's lack of education and immigration status made her a prime target for a "slick operator" like Struass Kahn". A single mother seeking aslyum to avoid having her daughter victimized by genital mutilation would be desperate and could explain, given the woman's lack of sophistication, her exaggerated or even false statements of forms she might not have clearly understood the importance of. It could also explain the victims erratic responses after the attack. While an argument could be made for this woman's having been dishonest to gain aslyum, that in no way precludes the fact that she was telling the truth about the rape.
Jordan stated that the Judge's actions to loosen restrictions on bail relealed "weakness" that could easily have been interpreted as a lack of confidence in the case by the jury. This could very well set the stage for a mistrial. "The Prosecution has not even completed its case and the Court is folding. This is disgraceful and testimony to the lack of skill and experience of the trial judge", Jordan said. END urged Plaintiff's attorney Thompson to secure "expert witnesses yesterday" and

to sequester the trial in a new location. 'Centre Street is a circus right now and the press are in a feeding frenzy for stories. The judge should have exercised greater judicial restraint under pressure from Defense counsel. "Most Americans do not realize how desperate immigrants are who seek aslyum in this country. Her statements were not honest, but they do not necessitate her lying about the rape. This does not mean that the Law excludes protecting ALL victiims"..

Jordan stated that the Guinean woman's confusion about where she was and exactlyl what she was doing were very typical of a trauma victim and at minimum they should have brought in an expert psychiatrist. As for Strauss Kahn "he's a ticking time bomb" and the Defense knows their case will fall apart once he takes the stand. As for the Plaintiff, Jordan suggested "Somebody call Gloria Alred" and renove the inexperienced ADA from the case. END stated that there simply was no excuse for her making statements that their case is in trouble in the press before the case is over. Disloyalty is not a quallity desired in prosecutors, END asserted.
"I am personally looking forward to watching the cross of Strauss Kahn so the DA better get an experienced heavy weight talent in there', Jordan remarked.
