The most alarming revelation about this ruling is the absolute power granted to the FDA by congress. See Louisiana v. Matthews, 427 F. Supp. 174 (E.D. La. 1977) (“Congress has granted broad, flexible powers to federal health authorities who must use their judgment in attempting to protect the public against the spread of communicable disease.”) You would think deaths by foodborne transmission must be epidemic to grant such unfettered powers to a government agency. According to the CDC's own report, 1809 deaths were attributed to foodborne transmission last year.

Consider the fact that 300 people die in the U.S. each year from penicillin allergies. Another 14,500 people die each year from taking NSAID painkiller medications. Nearly three quarters of a million people are killed by conventional medicine (drug deaths, surgical mistakes, iatrogenic deaths, etc, source: Death By Medicine). Congress does nothing to address these causes of American deaths.

The elected guardians of our rights have acquiesed our freedoms to regulatory agencies, special interests, BigPharma and BigAgri under the ruse of national security. The FDA is not bound by the Constitution or the Bill Of Rights when exercising these "broad, flexible powers". The court even states as much in this ruling. Keep in mind that the FDA is funded by the entities they regulate. Most of the people that approve the drugs and GMOs we are exposed to on a daily basis at the FDA are paid by the pharmaceutical, biotech and agricultural companies they regulate. The conflict of interest continues.

The following government appointees were either employed by, consultants to, or advocates for the "Bigs": Michael Taylor, the "Food Safety Czar" was part of the legal team instrumental in winning approval for the use of Monsantos growth hormone in dairy cows. Tom Vilsack, the Secretary of Agriculture, BIO (biotech) advocate. Islam Siddiqui, the US Ag Trade Representative is a former Monsanto lobbyist. Justice Elena Kagan defended Monsanto's fight to contaminate the environment with its GM alfalfa, as Solicitor General, in December of 2009. Justice Clarence Thomas, a former Monsanto lawyer refused to recuse himself from Monsanto vs Geertson Seed.

Americans are no longer the subjects of King George. We have evolved into being subjects of the FDA, TSA, Department of Homeland Security, The Department of Health and Human Services, and so on.
