More than one quarter of a million Canadians drink raw milk . The sale of raw milk is illegal in all of Canada and nearly half of the United States. The United States has a certified system for selling raw milk in nearly half of the states. Eight American states allow the sale of raw milk in stores for human consumption: Washington, Connecticut, South Carolina, Pennsylvania, New Mexico, Arizona, California, and Maine. In other states, like Florida, raw milk has to be labeled pet food. In states where the sale of raw milk is prohibited, persons can drink it from their own cows; people often "loophole" the law with the purchase of cow shares.

Some United States farmers conceded that raw milk safety risks are much higher at larger farms and that whether or not raw milk could ever be mass produced safely continues to be an uncertainty.

Canada holds that raw milk is unfit for human consumption because the bacteria in unpasteurized milk has been found to cause diseases like tuberculosis and salmonella. Canadian law maintains that only a cow's owner can drink it's milk unpasteurized; this makes giving away raw milk, even to family members against Canadian law. Canadian farmers that sell or give away raw milk can be fined two hundred and fifty thousand dollars, and be sentenced to three years in jail. However, the Canadian Food Inspection Agency has stated that they will not investigate raw milk issues unless they get a formal complaint or someone becomes ill from it's consumption.

Canadian raw milk advocates lobby for a certification process that would allow farms to market raw milk safely. These advocates argue that dairies have a monopoly and that only their economic interests are served by the prohibition of the sale of raw milk in all of Canada. Many raw milk advocates argue that instead of making milk healthy to consume, pasteurization requirements are designed to make milk last longer on the shelf making it more profitable for large dairies.

Many people report that raw milk tastes richer, that pasteurization kills good bacteria, enzymes and vitamins and that raw milk relieves and prevent many health issues, including: cancer, digestive problems, allergies, bad teeth, bad skin, increases metabolism, boosts muscle growth, and asthma related illnesses.
