Initial Hearing Scheduled in Federal Actos Bladder Cancer Litigation

Los Angeles, California, United States of America (Free-Press-Release.com) February 14, 2012 -- Los Angeles, CA, February 14, 2012 – The Honorable Judge Rebecca Doherty issued an order on Monday announcing that she would be appointing lead counsel for the consolidated Actos lawsuits following a March 22nd status conference set to take place in Lafayette, LA. Judge Doherty was assigned to oversee the proceedings after the U.S. Judicial Panel on Multidistrict Litigation voted to centralize all federal Actos lawsuits in the Western District of Louisiana in December 2011.

The plaintiffs in the lawsuits allege that Actos (pioglitazone) caused them to develop serious side effects, including bladder cancer. The litigants also claim that the drug’s manufacturer, Takeda Pharmaceuticals, knew of the potential bladder cancer risk but failed to adequately warn consumers of the possible dangers.

The lawsuits against Takeda and co-defendant Eli Lilly began mounting following a June 2011 safety communication issued by the U.S. Food and Drug Administration. In their announcement, the FDA warned that patients who used Actos for a year or more were at an elevated risk of developing bladder cancer. Following the announcement, sales of Actos have declined slightly but the drug remains a popular treatment alternative for adult patients with Type 2 diabetes.

Reportedly, the number of lawsuits filed against Takeda nationwide total less than 200 but that number is expected to grow. A December 2011 Bloomberg article suggested that Takeda could face 10,000 or more lawsuits in connection with patients who suffered Actos side effects.
