Insurance Publication Wrongfully Condemns Kenney Roofing Contractor

San Diego, CA - A misunderstanding that led William Kennedy of Kennedy Roofing (San Diego) to be charged for insurance fraud by the State of California Insurance Fund continues to haunt his business even three years after resolving the situation. In January of 2006 Kennedy was convicted of charges in insurance fraud regarding workers’ compensation and unemployment insurance. In a statement released by the Insurance Journal the publication states that Kennedy was sentenced to jail time, restitution, and volunteer work. The article also states that Kennedy falsified wages and time cards. All of these allegations are false.

Like in many situations, all was not as it seemed. The Insurance Fund requires that companies who pay hourly employees under a certain rate pay for each a certain amount for unemployment and worker’s compensation insurance; another amount is specified for employees paid over that certain rate. In the case of Kennedy, he raised the hourly rate of some of his employees unaware that he had to notify the Insurance Fund and pay a different fee for them being in a difference income bracket. When he was audited by the Fund, the mistakes were found and he was charged with fraud for simply making a mistake.

The press release made by the Insurance Journal is made up of gross exaggeration and fallacy. William Kennedy was put on probation and promptly paid what was rightfully owed to the California State Insurance Fund. Furthermore, Kennedy is still a policy holder with the State Insurance Fund. If he had deliberately committed fraud one could deduce that the State Insurance Fund would no longer carry his policy. This is not the case. The slanderous press release paints Kennedy as a criminal deliberately cheating the system. The fact is William Kennedy is a hard working contractor who committed an oversight.
