PLEASE TAKE NOTICE, that, pursuant to Minn. Stat. # 209.021, Jack Shepard the above named Contestant do hereby contest the Republican Primary Election for the Fourth Congressional District, (herein, “ Republican Primary Election) to select as the Republican Congressional Candidate for the Fourth Congressional District to nominated to be listed on the upcoming General Election Ballot to be held on November 2, 2010 as the Republican Candidate for the office of United States Representative from Fourth Congressional District of Minnesota, in the General Election to be held in the State of Minnesota on November 2, 2010. (“Election day”) and do hereby appeal that the Minnesota States Canvassing Board does not declare Teresa Collett, the Contestee herein, to have won the Republican Primary for the Fourth Congressional District which was held on August 10, 2010, and or if the decision of the Minnesota State Canvassing Board has declared Teresa Collett, the Contestee as winner the August 10, 2010 Republican Primary for the Fourth Congressional District of Minnesota
I do hereby appeal that decision of the Minnesota State Canvassing Board in declaring Teresa Collett, the Contestee herein, to have won the republican Primary election for the Fourth Congressional district and is entitled to have her name , Teresa Collett, the Contestee placed on the upcoming General Election Ballot to be held on November 2, 2010 as the Republican Candidate for the office of United States Representative from Fourth Congressional District of Minnesota, in the General Election to be held in the State of Minnesota on November 2, 2010. (“Election day”).

Jack Shepard, the Contestant herein, state, and allege upon knowledge, information and belief as follows:

1. Contestant Jack Shepard, as a federal candidate in the August 10, 2010, Republican Primary for the Fourth Congressional District of Minnesota (“Shepard”) is an inhabitant of the State of Minnesota. Jack Shepard was a candidate in the August 10, 2010, Republican Primary for the Fourth Congressional District of Minnesota. Jack Shepard object to the declaration or of having the Minnesota State Canvassing Board declare that Teresa Collett, the Contestee be declared the winner of the August 10, 2010, Republican Primary for the Fourth Congressional District of Minnesota. Jack Shepard (“The Candidate”) is a person whose name appeared on the official ballot and was a candidate for election in the August 10, 2010, Republican Primary for the Fourth Congressional District of Minnesota.
2. Contestee Teresa Collett is a person whose name appeared on the official ballot on the August 10, 2010, Republican Primary for the Fourth Congressional District of Minnesota.

3. Contest is based on the fact that the Contestee Teresa Collett, and the Teresa Collett for Congress Committee did deliberately commit seriously and material violations of the of Minnesota Election Laws. 211B.06 False Political and Campaign Material. Teresa Collett is guilty of a gross misdemeanour who intentionally participated in the preparation, dissemination of false campaign material designed to defeat the Contestant Jack Shepard, as a federal candidate on Aug. 10.
