There are many instances where as the taxpayer you can file for a Collection Due Process (CDP) Hearing in order to appeal the proposed collection enforcement. A CDP Hearing will allow a taxpayer to dispute the enforcement action or propose an alternative method of resolving their tax problem.
TYPES OF NOTICES TO REQUEST A COLLECTION DUE PROCESS (CDP) HEARING
A CDP is available if you receive one of the following notices:
• Notice of Federal Tax Lien Filing and Your Right to a Hearing under IRC 6320.
• Final Notice - Notice of Intent to Levy and Notice of Your Right to a Hearing.
• Notice of Jeopardy Levy and Right of Appeal.
• Notice of Levy on Your State Tax Refund – Notice of Your Right to a Hearing.
If you have received one of these notices, you may complete and file FORM 12153. You must propose an alternative to the collection action or your reasons for disputing the lien filing or levy action. Reasons for disputing may include such reasons as the following:
• Collection alternatives such as installment agreement or offer in compromise.
• Subordination or discharge of lien.
• Withdrawal of Notice of Federal Tax Lien.
• Appropriate spousal defenses.
• The existence or amount of the tax, but only if you did not receive a notice of deficiency or did not otherwise have an opportunity to dispute the tax liability.
In cases such as this, it is in your best interest to follow some advice from the IRS as stated in their publication “Your Rights as a Taxpayer - 64731W”. In Publication 1, paragraph 4 the IRS states, that you can either represent yourself or authorize someone that is allowed to practice before the IRS.
Don’t deny yourself the representation the IRS gives you a right to have. You don’t want to get into a situation that you can’t handle because, because they will not hold your hand and guide through each and every process.
