The IRS arbitration program is an alternative technique of settling disputes outside of the normal court proceedings. Instead of the case being heard by a judge or jury, an arbitrator / arbiter is the deciding party. Arbitration is available for those cases already in the Appeals process after either the settlement negotiations or attempts to enter into a closing agreement have failed under IRS Code section 7121. Even though this is not done in a court, the decision made in this arbitration is still legally binding.
