What is an IRS Reasonable Cause Letter? Everyone knows that when we as taxpayers, fail to file or pay our taxes on time, that the IRS will add additional penalties and interest to the balance due. They are not out to get you. The IRS has this procedure to help encourage all taxpayers to stay in compliance with the law. The Reasonable Cause Letter allows the taxpayer an opportunity to express why he/she didn’t file or was unable to pay.
Reasonable cause is defined as a set of events that would prevent or excuse them from filing or paying. Some acceptable reasons the IRS may allow are severe illness of the taxpayer or immediate family member, death of the taxpayer or immediate family member, or even that you were given erroneous information by an IRS representative. Will all these reasons, you as the taxpayer need to be able to substantiate your story. If you have a letter or any documents proving your sickness or the death in your family or the letter from the IRS representative expressing the instructions that you followed, make sure you send a copy to the IRS. Without some evidence to confirm your story, the story you just told is about as good as, ‘THE DOG ATE MY TAX RETURN’.
Now that you know what a Reasonable Cause Letter is and what may be accepted as such by the IRS, let’s cover how to write your letter. There is no exact template to follow so that the IRS will accept your reasoning, but making sure that your letter is clear and factual is the best practice. You will want to include the information listed below to accurately convey the story you are telling and remember to keep it as simple as possible.
• Full name as it appears on your tax return.
• Current address where you reside.
• Today’s date.
• Your social security number.
• A reference to the notice you received from the IRS. (If you have received one)
• List the purpose behind your letter. Express you wish to justify your ‘REASONABLE CAUSE’.
• Explain your story to establish reasonable cause.
• Summarize.
