KitchenStir in David and Goliath face-off with T-Fal

KitchenStir™ CEO Jeffrey Vicars is no stranger to developing patented technology and products for major appliance manufacturers to distribute. “The founders of KitchenStir have disclosed patented technology and IP (intellectual property) to the majority of appliance manufacturers selling branded cooking appliances in the USA, Canada, and Europe. We hoped to reach consumers in alliances with well-known brands; some of these polished brands revealed their agenda only after using our technology. T-Fal small appliances are manufactured in China, France, and elsewhere though the brand is dominated by their parent that we visited in France. T-Fal misled us during 3 years of documented communications and meetings with their product development executives regarding our IP. T-Fal is opening regional markets that T-Fal cannot control. Patents are territorial; KitchenStir utility patents are considered high value IP as the technology becomes essential in serving valuable markets. T-Fal executives refused to provide a detailed response to the claims of related KitchenStir utility patents.”
T-Fal has no issued U.S.A. or Canada utility patents related to the technology used by ActiFry. KitchenStir owns issued utility patents that supersede all related T-Fal ActiFry™ patent applications worldwide. KitchenStir Healthy-Fry is the only patented "self-stirring" oven and fryer in the U.S.A. and Canada. Neither KitchenStir nor T-Fal has merely design patents related to these products that offer protection for the shape and decorative appearance. KitchenStir has US Patent 6,845,707 and Canada Patent CA 2449600.
T-Fal a.k.a. SEB S.A. utility patent applications in Canada and the US have been protested for invalidation. Adequate effort should be spent on searching for the most related prior art, such that a patent application receives a fair examination, and such that the issuance of an invalid patent is avoided. Therefore, a Protest was filed against the Canada application CA 2,641,181, the US applications US2008/0213447 and US 2008/0163764 for invalidation.
SEB came to know the KitchenStir US Patent 6,845,707 and related products that embodied the same on the market no later than September 16, 2006, but failed to disclose this most related prior art, in a timely manner, to the French Patent Office, the World Intellectual Property Office, and the European Patent Office, to which Offices SEB had submitted multiple patent applications on the stir cooker technology, then, still in prosecution; which act established the factual basis of Violation of Duty of Disclosure and Inequitable Conducts in their dealing with these esteemed Offices.
