LADER release White Paper to MP’s and Local Authorities
White paper written by John Kruse, Social Welfare Expert, Philip Evans co-founder of the Enforcement Law Reform Group and Jamie Waller, CEO of JBW Group responds to ITV programme “Bailiffs Exposed”

The Local Authority Debt Enforcement & Recovery (LADER) Report on Local Authority tendering for bailiff services published today raises critical issues about responsibility for the declining public perception of bailiffs and the scope for improvement through legislative change.
With the Government’s declared aim of clamping down on aggressive bailiffs and its long overdue consultation on bailiff regulation now not expected until the economic outlook brightens, what action is necessary to prevent the enforcement regime falling so far into disrepute that it ceases to be credible?
Following the publication of this report these three industry leaders are arranging an important one-day conference at the House of Lords on the 24th November 2011. At this event MP’s and Local Authority Officers will hear the experts discuss the impact of local authority mismanagement on the industry’s credibility. Topics for discussion are:
- What is the impact of profit sharing on debtor vulnerability?
- Do Local Authority staff know enough to be entrusted with overseeing enforcement?
- Should the responsibility be returned to the courts or transferred to a new, centralised
national body?
This launch conference will be hosted by Lord Lucas, Chair of both the Enforcement Law Reform Group and the London Motorists Action Group and chaired Philip Evans, industry expert, conference speaker and author of ‘The Bailiff Pocketbook’.

LADER’s expert panel:
John Kruse
John Kruse has worked in the field of social welfare law for the last 28 years. He has specialised in enforcement law for over 22 years.
During that time he has written several books on the subject and numerous articles in the professional and academic press. These include a two volume history of bailiffs’ law as well as Law of seizure of goods and Powers of distress.
In addition, John has provided consultancy services to bailiff firms, to the Ministry of Justice and the Council of Europe.
He has worked as trainer with local authorities and advice agencies, advised the media on enforcement related programmes and articles, acted as a complaints adjudicator for two of the main bailiffs’ trade bodies and he has sat on several committees and expert working parties considering reform of the law. John is editor of the Bailiffs’ Law Bulletin and has written the Practice Note series which accompany the Bulletin.
Philip Evans
Philip has been involved with bailiff law and practice since the 1980s. He served in the Lord Chancellor’s Department for 26 years.
In the final years, while working at headquarters, he wrote the County Court Bailiff Handbook, worked on Lord Mackay’s review of bailiffs and headed an internal review of the county court bailiff service.
After leaving LCD, Philip was Secretary to the Certificated Bailiffs Association (now the Enforcement Services Association) for three years and then National Director for the Sheriffs of England & Wales for one year. In 1998, he was co-founder of the Enforcement Law Reform Group and was its chair from 2002 until 2007.
During the passage of the Tribunals, Courts & Enforcement Act 2007, Philip assisted MPs and peers, worked with lobby groups and he remains a strong advocate of the repeal of (or substantial amendment to) the bailiff provisions in the Act.
In 2002, Philip began teaching personal financial skills, mainly to young people, and he now divides his time between this and consulting on bailiff issues. Philip is a frequent contributor to trade journals and is an experienced conference speaker (and chair) about debt, enforcement and related issues.
He has written Rough Guide to Bailiffs & Bailiff Law and Bailiff Pocketbook. He has also written a number of books to help people manage their personal finances better: the latest is, MONEY: the small print.
Jamie Waller
Jamie Waller has been involved in the bailiff industry for over 15 years and manages one of the UK’s leading debt recovery and enforcement solution firms. Jamie’s JBW has won various awards for ethical working practices including the prestigious Sunday Times Top 100 Companies to Work For.
Other noteworthy awards for JBW include Best Company 2010, Best Business Awards Winner 2010, Crème de la Crème Business Awards 2010 and the Global Business Excellence Awards 2010.
Jamie is also a media personality and has starred on several primetime BBC 1 TV programmes and is also a regular expert media commentator in the media appearing on shows including BBC Breakfast.
He has also won a number of prestigious awards himself including the Young Business Leaders Award 2010, the Growing Business Young Guns Award and the Who’s Who of Britain’s Business Elite 2010.
