LegalView Announces Update to Medical Malpractice Information Portal
A new study shows that medical malpractice lawsuits are decreasing which is not contributing to the rising cost of health care.

LegalView, an online legal resource, has updated its Medical Malpractice Portal.
According to a recent study, medical malpractice lawsuits are not contributing to the rising costs of health care. Many believe that the amount and severity of medical malpractice suites are increasing, and this just isn’t the case says a report put out by Zurich, one of the leading insurers of hospitals and health care organizations across North America.
In this report, data from 1,600 hospitals from 1997 through 2007 was collected and analyzed. The results of the study have surprised many. For example, the number of medical malpractice claims, determined by comparing the number of occupied beds to the number of legal claims filed, is in decline. Currently, the claim frequency is 1.96 claims per 100 Occupied Bed Equivalents, or the number used to measure hospital occupancy.
In addition to the number of medical malpractice claims, the Zurich report examined the severity of such claims. The report shows that over the past 11 years, the amount asked for in a medical malpractice claim has remained restively stable.
Congress has proposed reforming the way that medical malpractice lawsuits are regulated, but proponents claim that since the number and severity of medical malpractice claims are down, reform would not do much to curb the rising cost of health care. These reforms would only cut down on health care spending by $11 billion, or 5 percent. It is estimated that the United States spend about $2.4 trillion dollars a year on health care.
Malpractice and medical negligence occurs when a person suffers unnecessary injury or death as a result of a negligent or incompetent action by a medical professional. Some examples of such actions include: misdiagnosis of or a failure to diagnose a disease, failure to provide appropriate medical treatment for a disease, surgical errors, or unreasonable delay in the treatment of a diagnosed disease.
It is estimated that medical malpractice liability kills 225,000 people every year in the United States. Although many people who are affected by medical malpractice do not die, they are injured- sometimes permanently.
