Several publications in China are carrying a couple of articles these days on the reforms of the railway judicial organs.

Several publications in China are carrying a couple of articles these days on the reforms of the railway judicial organs. According to the news or articles in those media, the judicial personnel in the railway system will become part of the civil service personnel and have to pass the civil service exams and the railway judicial system will be placed under the local control.
Currently the Chinese railway ministry and railway company have their own special railway courts, railway police and railway procuratorate, all under the control of the railway ministry and independent from any local courts, local police or local procuratorate.
Lawyers of Lehman, Lee & Xu holds that the reform of the railway judicial organs in China is necessary and important. “Apparently a judicial system that answers only to the Railway Ministry is fundamentally unjust and it is difficult to ensure judicial independence under such a system as it is,” said Mr. Lehman, Managing Director of Lehman, Lee & Xu.
