Luvdarts LLC & DigiPie File Opening Brief in Appeal Against AT&T, Verizon et al in Ninth Circuit

Luvdarts LLC & DigiPie have filed their opening brief in their copyright infringement appeal against AT&T, Verizon, Sprint and T-Mobile. What's at stake here is nothing less than the future of.......

Los Angeles, California, United States of America (Free-Press-Release.com) September 21, 2011 -- On September 20, 2011, the appellants' brief in the Luvdarts LLC et al v. AT&T et al was filed in the Ninth Circuit. The case number is 11-55497 (linked below).

What's at stake here is nothing less than the future of creators' rights to monetize peer to peer sharing of their content. Mobile multimedia messaging (MMS) is not some great new art form that will inspire new heights of creativity at this point. Its potential as a new tangible medium of expression is only just beginning. But, at this moment in time - MMS is a secured system that can provide true accountability for transactions of stuff being exchanged.

Amongst the questions now before the Ninth Circuit is the question of whether or not the Defendants/Appellees, AT&T, Verizon, Sprint and T-Mobile had the right and ability to control the peer to peer transactions via MMS. The Defendants denied that they had the right and ability at the District Court.

Within the brief, Plaintiffs/Appellants present compelling evidence that the carriers have indeed had the right and the ability since as early as 2002. They just never turned on the switch.

Floyd Crump, a managing member of Luvdarts LLC had this to say, "Besides our obligation to protect our assets from being abused, our goal is to bring attention to the reparable flaws within the carriers' new system for distribution for the good of the whole. If they want to provide new content distribution networks outside of the Internet, they've got to do it right."

Floyd goes on to say, "Fortunately, Perrin F. Disner our attorney, has articulated these flaws and remedies very well in his brief.
