Luvdarts LLC et al v AT&T et al – Not Frivolous, Not Unreasonable, Not in Bad Faith!

Yesterday a federal judge in the Central District of California denied the Defendants’ (AT&T, Verizon, Sprint and T-Mobile) motion for attorney fees against Luvdarts LLC and DigiPie (CV 10 – 05442 DDP).

Yesterday a federal judge in the Central District of California denied the Defendants’ (AT&T, Verizon, Sprint and T-Mobile) motion for attorney fees against Luvdarts LLC and DigiPie (CV 10 – 05442 DDP). The Court concluded that although it granted Defendants’ motion to dismiss, Plaintiffs’ claims were neither frivolous, objectively unreasonable or in bad faith.
Floyd Crump, a managing member of Luvdarts LLC commented, “Obviously we welcome not being stuck with the Defendants’ legal bills but more importantly the Court sent a message to these large corporations that it is not acceptable to play the money card in an attempt to stifle a valid opposition.”
Max Davis, the founder of two non-profit organizations that have been advocating for cooperation from the wireless carriers and government in dealing with these peer to peer file-sharing issues said today, “We have always set out to be productive for the good of the whole with our initiatives. The wireless carriers only need to fess up to the reparable flaws in their MMS systems and get on with it. Otherwise, as we predicted years ago they will be seeing a lot more of these infringement suits. With every day going by, other creators and the general public are becoming more and more aware of these flaws,”
Also, Perrin F. Disner, formerly of the Disner Law Corporation, is stepping in as lead counsel for Luvdarts LLC’s copyright infringement action and appeal against AT&T, Verizon, Sprint and T-Mobile.
Luvdarts LLC et al v. AT&T et al is currently under appeal with the United States Court of Appeals for the Ninth Circuit.
