Luvdarts LLC et al v. AT&T, Verizon, Sprint and T-Mobile – Case Dismissed With Prejudice!

Yesterday a federal judge in the Central District of California dismissed the Luvdarts LLC et al v. AT&T Mobility et al civil case with prejudice. The Court concluded that Plaintiffs did not plead plausible claims for inducement, contributory or vicarious infringement by the Defendants, AT&T Mobility, Sprint Spectrum LP, T-Mobile USA and Verizon Wireless.
Floyd Crump, a managing member of Luvdarts LLC commented, “Considering what we’re up against we were already prepared to appeal. Our legal team has already gotten the ball rolling for this and according to them we are in a better place within the appeal process. It may take a little longer but we’re sure we can show that we plead the issues correctly.”
Max Davis, the founder of two non-profit organizations that have been advocating for cooperation from the wireless carriers and government in dealing with these peer to peer file-sharing issues said today, “For our organization’s purposes the appeal process is a best case scenario for our members will now be in a position to help write new law in these new areas. If these MMS peer to peer transactions are not addressed soon we will all wind up with a bigger mess than what happened via the Internet with these very same issues.”
Legal team member Glen Davis of the Douglas Davis Law Group said, “As Floyd said, we were ready for this outcome and on the bright side there were some very significant legal theories fleshed out via our FAC. This is far from over.”
“That’s right.” Max adds, “In fact the wireless carriers have a choice to keep on resisting our positive movements for these issues or face even stronger opposition of another level. All we want them to do is sit down at the table and deal with these issues in a productive manner for the good of the whole. They will soon find out, we’re only just getting started.”
