Many FL DUI Cases in Question Due to Breath Testers

A recent news story investigated the use of faulty breath testers by the Florida Department of Law Enforcement. The results could affect thousands of FL DUI cases.

In a story covered by WTSP in St. Petersburg, FL, it revealed that Florida law enforcement employs faulty breathalyzer tests, along with uncertified testers.
The story features an interview with FL DUI expert Stephen Daniels, who asserts he’s found a plethora of problems with Florida’s alcohol testing program. He claims that the alcohol testing device, the Intoxilyzer 800, is giving false results.
Additionally, WTSP news investigators found evidence that the Florida Department of Law Enforcement hired testers who did not receive certification or recertification to give the test to people suspected of a FL DUI.
This means 61 FL DUI cases could be thrown out in Pinellas County alone. There could be thousands of FL DUI cases statewide that need to be reexamined because of this finding.
However, the Florida Department of Law Enforcement is claiming that they aren’t aware of any problem with the Intoxilyzer 8000 or any uncertified employees.
