With the increasing sensitivity of forensic DNA testing, a visible body fluid stain is no longer necessary to achieve DNA typing results. Minute amounts of biological material can be typed reliably using the latest DNA typing systems. In many criminal cases, there is insufficient material for replicate testing. This poses a problem for the criminal justice system.
Law enforcement crime laboratories generally strive to minimize their consumption of biological evidence so that a portion can be preserved for possible re-testing at the request of a defense attorney. According to the 1996 report issued by the National Research Council, entitled ‘The Evaluation of Forensic DNA Evidence’, “whenever feasible, forensic samples should be divided into two or more parts at the earliest practicable stage and the unused parts retained to permit additional tests.”
When limited amounts of biological material exist in a criminal case such that only one DNA test can be performed, the defense often has the right to have their expert present to witness the testing. Law enforcement crime laboratories may see this as a distraction to the analyst performing the testing. It is imperative that the defense expert be properly qualified as a DNA analyst and be well aware of the delicacy of the process.
