However, under the department medical guidelines, he is expected to recover within 28 days. As a result, he was referred to two doctors for further diagnosis. The claimant had to undergo both psychiatric and orthopedic examinations on September and October, 2009 respectively.

The two examinations concluded that the claimant was able to perform his regular work as of the date of the examinations although the claimant disputed it as his doctor held a contradictory opinion and evidence which establishes that the claimant is still unable to work.

Thus on November 12, 2009, the claimant filed an appeal.
