MicroAire’s Misleading Claims Refuted by Euromi

Euromi S.A. of Belgium stated today its determination to defend itself against recent misleading claims asserted by MicroAire.

MicroAire asserted yesterday on its website that Euromi “is prepared to discontinue sales of its Lipomatic device no later than the last week of December 2011.” “MicroAire’s statement and implication are completely false,” stated Pierre Mileur, Export Manager for Euromi S.A. “Euromi is not discontinuing sales and support of Lipomatic devices, but instead is making a minor change to the devices to be sold after the last week in December, 2011, in connection with disputed terms relating to the location of structures outside the housing of the tool.”

The attorney communication referred to by MicroAire on its website as forming the basis for MicroAire’s claims is reproduced in part below:

“We have reviewed the issues raised in your above-noted letter, and cannot agree with your conclusions of infringement of the '700 and '518 patents. However, in the interest of reaching a resolution of this matter, our client has investigated the ‘ideal solution’ you mention in the penultimate paragraph of your letter. Specifically, claim 72 of the '700 patent recites: ‘a reciprocating member mounted within said housing and having portion [sic] exterior to said housing,’ and ‘a cannula releasably attached to the portion of said reciprocating member exterior to said housing.’ The remaining claims at issue include identical or substantially identical limitations. Our client is proceeding with a redesign of its product to eliminate all structures that could logically be contended to be encompassed by these claim limitations.”
