Missouri Injury Attorney Joshua P. Myers obtains $500,000.00 Verdict

Missouri Personal Injury Lawyer{/b} Joshua P. Myers obtained obtained a jury verdict on August 4, 2010 in the United States Federal Court Eastern District of Missouri. The case was Burroughs v. Zurich American Insurance Company, et al. Myers' client was the driver of a tanker truck for Flying J. On March 9, 2007, he was driving in the far left lane of eastbound I-70. As he approached Bryan Road, he was struck by another tractor-trailer driven by an employee of Mackie Moving Systems Corporation, a Canadian Company. The Canadian truck did not stop but kept on driving. He was only identified because a witness retrieved the license plate information from the truck and called the Missouri State Highway Patrol. The driver of the Mackie truck later denied that any such incident occurred. On the day before trial, Myers settled with the trucking company. He then proceeded to trial against two insurance companies, Zurich American Insurance Company and AMCO Insurance Company. Each of these two insurance companies provided what is known as uninsured motorist coverage.

"Although we feel that the Mackie truck driver bore some fault, we did not feel that he is what created this wreck. Rather, an eyewitness on the scene described that the wreck was caused due to cars merging onto I-70 from the Bryan Road on-ramp. Specifically, she described a white car that merged onto the interstate then suddenly swerved over when there was no room to do so. By doing this, it caused a chain reaction whereby cars began swerving left into each other's lane and that is what caused the Mackie truck to swerve over into my client".

Myers notes that the owner of the white car was never identified. That is why the uninsured motorist coverage came into play. His client's own insurance company denied all liability and never offered a dollar to settle the case. During closing arguments, Myers asked the jury to send his clients out with nothing if they did not believe them. But if they did, he asked them to award his client's with every last cent they deserved and specifically requested a total of $500,000.00. After three and a half hours of deliberation, the jury returned a verdict of $500,000.00.
