NC Bar Ethics Vice Chairman David N. Allen "Violator of Decency"

North Carolina State Bar Vice Chairman of the Ethics Committee (Attorney David N. Allen) awarded the "Violator of Decency" award from the Legal Justice Corporation.

The Legal Justice Corporation has formally awarded Attorney David N. Allen the North Carolina State Bar Vice Chairman of the Ethics Committee the "Violator of Decency" award. According to Gary G. Gleason (the President of the Legal Justice Corporation), this much deserved award was presented to Attorney David N. Allen for his lack of response to a letter sent certified/registered/return receipt from a citizen of North Carolina. There has been no response from Attorney David N. Allen (or the other 19 members of the "Ethics" Committee who also received the certified/registered/return receipt mailing) in over 120 days. The Legal Justice Corporation will award the "Violator of Decency" award to the remaining members of the "Ethics" Committee who received the letter over the next several weeks.

The President of the Legal Justice Corporation further stated - "It is time to end the "Good Ole Boys" club at the North Carolina State Bar and open the doors and let "Justice" back in!" He further stated, "The North Carolina State Bar has purposely and intentionally designed a closed door system to protect favored members of the Bar from exposure and punishment". "The system promotes a multi-level system of law application and creates double and triple standards amongst the citizens of North Carolina." He added, "If an attorney had sent the certified/registered/return receipt letter demonstrating obvious breech of ethics, a reply would have been received within 10 days ... but apparently, the North Carolina State Bar "Ethics" Committee members do not feel they need to reply to a "commoner" of the state ... a double standard." "How can you sit on an "Ethics" committee and be that unethical?"
Mr. Gleason also stated, "The North Carolina State Bar wants the citizens of this great state to believe the NC Bar is here to protect them from the evils of law and that is pure hogwash." "Granted, the original purpose of the North Carolina State Bar was to regulate and oversee the judicial system for the benefit and protection of the people ... but clearly, the North Carolina State Bar has morphed into a secret society of elitists who protect favored members ... the members of the "Good Ole Boys" club."

The letter sent to the "Ethics" Committee follows :

NC State Bar Ethics Committee Member:

I am sure we would all like to agree that our legal system is fair ... but we all know better. There is clearly a "Good Ole Boys Club" mentality and method of practice thereof that exists. As a member of the "Ethics" Committee of the North Carolina State Bar, you now have an opportunity to prove me right ... or prove me wrong.
I have no intention of burdening you with dates and drama ... just a few of the facts.

1) An attorney was hired to file a non-contested child support document. He agreed via e-mail to have the Court document clearly state $150 every 2 weeks and not $300 per month. The document came back stating the Plaintiff was to be awarded $150 every two weeks and taken out via payroll deduction at $300 per month. The document was in conflict and non-enforceable. Said attorney refused to correct the uncontested documents (a fifteen minute fix) and instead, opted to withdraw from the case.
This same attorney NEVER sent monthly statements of the Trust Account as required by the North Carolina State Bar. It was reported to the Bar ... and NEVER acted on. (See section 6.) Bruno was never heard from ... perhaps it was because the "Trust Accounting - When the Audit Man Calls" classes were already scheduled at the office of said attorney.

2) The Judge allowed the attorney to withdraw advising the Plaintiff to go to the 3rd floor and correct the documents himself. Judge stated - "You paid for a Court Order ... You got a Court Order ... if you have a problem with the Court Order you need to go to the third floor ...". Enough said.
3) Instead, another attorney was hired to correct the filing. More fees were paid by the Plaintiff.

4) The original attorney refused to refund his fees after the obvious breech of contract. He was asked to refund the monies no less than three times by plaintiff's current attorney. Additionally, please note the contract was written on letterhead (with the names of all practicing attorneys listed) which legally binds all parties on letterhead to contract and breech thereof. All attorneys of the firm share the same Trust Account violation and are all guilty of failing to follow the Regulations as set forth by the North Carolina State Bar.

5) In quick summary, a police report was filed and was passed along to the criminal investigation unit ... the investigator wanted little or nothing to do with it and passed it up to the District Attorney's office .... who wanted nothing to do with it and tossed it over to the North Carolina State Bar .... who promptly swept it under the secret carpets of Cary ... When it was taken before Judge Richard Boner ... it was simply tossed out. When brought to the attention via e-mail to the North Carolina Bar "Association" Professionalism Committee - only ONE member even bothered to respond.
Is the pattern sounding kind of familiar? Yes ... apparently this type of "cover-up" and "not my problem attitude" happens way too often. After all, the theory is "we are attorneys ... what can they do to us?" or "don't bother with a refund ... they will eventually go away". I guess they hadn't planned on screwing over a guy like me. Guess no one thought the internet would empower the people and expose the "Violators of Decency". Guess they pushed the wrong button this time.

You might be thinking ... "Who are the culprit attorneys here?" ... "I'll take the proper action and clean this mess up!" ... but when you find out who they are ... will you still take the same stance? After all ... no one else has. It is your DUTY to do so ... but will you?
On the other hand ... you may take the standard attorney stance and stand determined to "teach me a lesson" or find a way to "get me back" for the actions I have taken to expose these "Violators of Decency". From what I have witnessed ... attorneys are trained ONLY to fight ... not to reconcile and certainly trained not to admit any wrongdoing. A true plague on society.

6) Attached you will find letters of either obvious cover up or blatant negligence of duty (or both) from none other than North Carolina State Bar's Leanor Bailey Hodge. Will this be swept under the secret carpets of Cary too ... or will you dig down and get to (and uncover) the truth? Are you willing to do your job? If not ... I suggest you resign from the ethics committee post haste. Do I need to bring a suit against the North Carolina State Bar in order to get someone's attention? How far does someone need to run the flag up the flag pole before someone decides to get involved ... and more importantly ... do what is right? Does the matter need to be forwarded to the North Carolina Attorney General's office. Do we need to bring in the United States Attorney General because NO ONE in the entire state of North Carolina is willing to do the right thing. Just imagine the press coverage on that.
You do not know me. You may not like me or my methods. It doesn't matter. You must decide if you WANT to do the right thing. You must decide if you WILL do the right thing. You must decide which side of the ethics equation you are on. (Apparently there are two sides of the equation that are not equal ... even though they should be ... one side of the equation feels they are above the laws of decency and the civil and criminal laws of the Courts they practice in.) You must decide if John Q. Public wins over a bunch of "Violators of Decency".

You may blame me for bringing shame and exposure to the legal arena. You may blame me for taking up your time for something you view as trivial or trite. You may blame me for the possible bad press and negative exposure the "Ethics Committee" members and North Carolina State Bar may receive. But think again. It is YOUR failed system ... not mine. Who really deserves the blame for the wrong doing? Who is the real culprit? Isn't it the attorney who cowardly walked away from his responsibilities and isn't it his fellow "Violators of Decency" at the law firm he represents who refuse to come clean? Isn't that who EVERY decent, law abiding, ethical, and upstanding attorney should be upset with? They too are tired of the bullying and "Good Ole Boys Club" mentality. Who do you stand with? Which side are you on? There is no middle ground here.

The attorney who failed in his duties has not only failed me ... but has now failed you and the system you represent. The attorney who failed his duties has cowardly jeopardized the reputation of everyone in his office and now has potentially jeopardized your reputation. You will not be allowed to sit in the middle and do nothing. I am simply not going to afford you that opportunity. I've been through enough. John Q. Public has been through enough. We are both running out of patience with the "system". You must decide to either show no ethics have been breeched or take the appropriate action. Attorney Steven B. Ockerman has broken the laws of decency. Every attorney on the letterhead/contract of Wishart, Norris, Henninger & Pittman (Charlotte, NC) have broken the laws of decency. Leanor Bailey Hodge has broken the laws of decency, shamed her position, and should be removed immediately from her duties at the North Carolina State Bar.
