They can now benefit from an array of temporary relief measures that has been made available by United States Citizenship and Immigration Services (USCIS) as a response to a recent devastating tsunami and earthquakes. These immigration benefits include, but are not limited to the following:
1) U.S. citizens and Lawful Permanent Resident can requests an expedited processing of a Form I-130 (Petition for Alien Relative) filed on behalf of their Japanese immediate relative, if a visa number is readily available. This can be very helpful to US citizens and permanent residents seeking to reunite with their spouses, children, parents affected by the disaster.
2) As a rare exception to a policy prohibiting extensions beyond 90 days of stay under Visa Waiver Program (VWP), Japanese nationals are granted an exception to request an extension of their current VWP status in the US. If a Japanese national was admitted to the US under the VWP and is unable to return because of the recent disasters in Japan, they may request what is known as “satisfactory departure.” If granted, they will have up to extra 30 days to leave the United States without penalty for exceeding their authorized stay in the US.
3) A Japanese national holding an F-1 student visa might be eligible to apply for employment authorization based on severe economic hardship if her family in Japan has been funding her studies in the US and a recent disaster has affected their ability to do so.
4) Japanese nationals in the US are now eligible to file an application to change or extend nonimmigrant status (for example, B-1/B-2 or H-1B visa), even when the request is filed after the authorized period of their stay has expired.
