Obama Health Reform Requires Plain Language

Affordable Care Act requires insurers to describe coverage, limitations in plain language

Washington, DC (PRESS RELEASE) February 9, 2012 -- The US Department of Health & Human Services (HHS) has just published its final regulations to the Affordable Care Act. One important provision it contains is that the Obama health reform requires plain language for communications between insurance providers and the people they cover. The Affordable Care Act requires insurers to describe coverage details and limitations in plain language to eliminate the confusion so often associated with private and individual health insurance in effect today.
Working with today's method of selling private healthcare insurance, what seems like affordable health insurance with full coverage during the initial comparison of health insurance quotes quickly becomes almost uselessly cheap health insurance when medical care is needed most. Kathleen Sebelius, HHS Secretary, describes this plain-language requirement as a "new edge in deciding which plan will best suit" individual need.
According to Sebelius, "All consumers, for the first time, will really be able to clearly comprehend the sometimes confusing language insurance plans often use in marketing." The new rules are a joint publication by the US Departments of Health and Human Services, Treasury, and Labor.
Two very important elements of the plan include:
Summary of Benefits Coverage (SBC) that must be written in short and easy-to-understand terms.
Uniform glossary of the health insurance terms used most often, such as co-payment and deductible.
These elements must be included in the marketing material of all healthcare insurance providers and they must be written in a style that is clear, straightforward, and easy to understand by individuals comparing health insurance quotes.
This final requirement for plain language in health insurance materials is part of the reform rules proposed in August 2011. Working with the government committee on healthcare reform was the National Association of Insurance Commissioners (NAIC) and various consumer and patient advocacy groups as well as healthcare professionals. Also included in drafting the final rules were advocates representing current and potential patients with limited proficiency in the English language.
