Open Letter to Robert Norris (Attorney - Wishart, Norris, Henninger & Pittman) Charlotte, NC

April 18, 2011

Wishart, Norris, Henninger & Pittman bring Shame to the Legal Community of Charlotte, NC. Read how an embarrassing fifteen minute mistake has turned into a potential fifteen million dollar problem.

FOR IMMEDIATE RELEASE
(Free-Press-Release.com) April 18, 2011 -- Attorney Robert Norris,

Since you were a deacon, elder, and member of the First Presbyterian Church
of Burlington, I can only assume you were raised in a God fearing and God
loving family. More than likely, you maintained a fairly high grade point
average throughout your years of education, was perhaps a talented athlete,
and was relatively popular amongst friends and classmates. You probably did
well in your undergraduate studies and decided to go to law school. Like
everyone else who decides to go to law school ... you wanted to right the

wrongs of the world. You wanted to come to the aid of the downtrodden man.
You wanted to make a difference. You wanted to make a name for yourself. I
ask you now ... did you lose your focus somewhere along the way? After all,
no one goes to law school with the ambition of becoming a bullying, street
thug attorney or wanting to be known as a "Violator of Decency". I believe
you have lost your focus and have become what is commonly defined and well
known in the circles of law (and quite possibly Black's Law Dictionary)
as "Pompous". Further defined as someone who is

too good to admit error and make the necessary corrections thereof while
hoping the cheated party(ies) will eventually (and simply) go away.

Almost five years ago, your associate Attorney Steven B. Ockerman (AKA "The
Black Sheep of the Office" per your personal paralegal) made a huge error
when working on my case. Via e-mail he clearly stated he acknowledged my
request to have the Court Order provide me with an undisputed $150 every
two weeks and NOT $300 per month since they do not add up the same.
He, in fact, completed and submitted a Court Order that stated I was to

receive $150 every two weeks for child support. The next line of the Court
Order stated the sum was to be paid via payroll deduction at a rate of $300
per month. The Court Order was in conflict with itself and was
unenforceable. Mr. Ockerman cowardly refused to admit he had made an error
... and more importantly, refused to fix his mistake. It was an uncontested
matter. It required nothing more than having himself or a paralegal make
the corrections on the document, have the parties resign, and re-submit to
the Judge for signature. This is pretty common in the practice of law. No
big deal.

After another round of cowardly actions, Mr. Ockerman refused to take any
phone calls, e-mails, or faxes from me. Because of Mr. Ockerman's actions
(and lack thereof) a rather lengthy letter of approximately 60 pages was
sent to every attorney within your practice explaining the situation and
asking for their intervention. There was NO RESPONSE to my letter from
anyone from your law firm including yourself, a founding member. That
doesn't say much for the character and ethics of the Wishart, Norris,
Henninger, & Pittman law firm. The conditions of the contract were not met.

The contract was clearly breeched on your behalf. Be very aware that my
contract was NOT with Steven B. Ockerman. My contract was with the Wishart,
Norris, Henninger & Pittman law firm. Take a moment to review your own
contract and note that it is on standard letterhead of which all listed
attorneys can (and will be) held accountable for potential Malpractice.

At that moment in time when the 60 page letter was sent to all practicing
attorneys within your office ... your employees and co-workers had to be
questioning your actions and more importantly ... the lack thereof. You

co-founded the Wishart, Norris, Henninger & Pittman law offices. Your last
name is on the company title ... the corporate name. Your name and
reputation were at risk. Did a "pompous" attitude get in the way of a sound
business decision? The educated masses believe so as you simply sat back
and chose to do NOTHING .

I called the North Carolina State Bar and they suggested I call your office
mediator for resolution. That was a joke. I received nothing but a nasty
letter from Attorney Robert Wishart with a check that didn't cover the full

amount deserved nor did it reimburse me for the attorney fees for the new
hire. Your checks were never cashed.

The letter stated -

Dear Client:
Maria has asked me to review your memo of August 21, 2007 with the lengthy
and sometimes defamatory attachment. Frankly I have little patience with
someone who feels communication with venom and sarcasm is an effective way
to discuss issues which should be addressed civilly and maturely. That said,
I will respond to you anyway.

It appears that you are correct concerning the over charge on the

consultation. Enclosed you will find a check in the amount of $100.00. You
should have been charged and should have paid only $100.00; in fact you were
billed for $200.00. We were mistaken and for that we apologize.
Second, no one here needs to be educated on the obvious conclusion that
$150.00 every other week is different from $300.00 per month. You were
provided the documentation which established the child support payments well
in advance and were instructed to read it carefully. Steve has no
recollection that you called him and addressed the discrepancy between the
two payment schedules.

Nevertheless, and principally because we would prefer never to hear from you
again, I am enclosing a check for $900.00. This represents the present value
of the $1,350 which you contend you have or will overpay because of the
bi-weekly schedule. As you know, $1,350 spread out over 52 months is not
equal to $1,350 when reduced to present value. Please recognize that this
payment of $900.00 is not predicated on my belief that you are entitled to
it. I simply feel that it's a relatively small price to pay to help assure
that we never have to hear from you or of you again.

Very truly yours,
Robert J. Wishart.

I guess he thought I would simply, and eventually, go away like so many
before me. (I am not going anywhere in case you hadn't noticed.)

I was forced to hire (and pay for) another attorney to correct the mistakes
made by your law firm. During this process, my attorney (Christopher
Johnson) suggested to Mr. Ockerman that he make this wrong right. The only
response received was derogatory comments about me. The papers were filed
with Superior Court. Word started to spread.

After the filing ... both outside attorneys (and your in house attorneys)
were beginning to question your practices and the ethics your offices
portrayed. Once again, you chose to do NOTHING. You simply told those that
questioned the actions that I was merely a 'whacked out, disgruntled client'
and that I was to blame for the errors made.

Upon signing contracts with your firm, I was asked to give $100 for office fees and a $1,500 retainer.
Seemed kind of outrageous for an uncontested matter and was informed I would, more than likely

get a large portion back. Four or five months later, I received a statement of my account and I NEVER received
monthly statements as required by the North Carolina Bar Association. The statement was for $1,660.
According to the statement, I had a balance of $60. I sent Mr. Ockerman an e-mail asking what was going on
and he replied that an error was made and he sent me a check for $60. Several months later, he stole another
$1,680 or so. Is this really how business is done at Wishart, Norris, Henninger & Pittman, PA?
A police report was filed for fraud and stealing of funds by misuse of a

credit card. The District Attorney wanted nothing to do with it and said it
was a matter for the North Carolina Bar. Imagine that. The North Carolina
Bar did nothing about it and flat out ignored the claims about a Trust
Account violation. (Again - Attorney Steven Ockerman NEVER sent monthly statements
as required by the North Carolina Bar Association). Imagine that.
Investigator Bruno never investigated the claim nor did he review your Trust
Account and Statements thereof. Imagine that. You later (and quite
conveniently) hosted two of Investigator Bruno's classes on Trust
Accounting. Imagine that.
