Key Steps in Calculating Employee's Regular Rate of Pay

Calculating the regular rate of pay is essential for determing the amount of additional compensation an employer is required to pay to an employee who is not exempt from the overtime provisions of the Fair Labor Standards Act (FLSA).
Additional compensation (Overtime Pay) is paid to a nonexempt empoyee for ALL hours worked during a given workweek that are in excess of the statutory maximum. The Federal Statutory maximum is 40 hours per workweek. Exempt employees include, but are not limited to, executives, administrative employees, learned professionals, creative professionals, and outside salespeople.
The FLSA requires employers to pay overtime to nonexempt employees for hours worked in excess (over) 40 hours per work week (Typically Sunday through Saturday). Each workweek stands alone with respect to the number of hours worked for overtime compensation.
