Prohibit work on Hiranandani’s project site: Magistrate orders revived

Mumbai, Maharashtra, India, Republic of (Free-Press-Release.com) August 12, 2011 -- As informed earlier that the Ld. Magistrate at Vadgaon had restrained the project proponents (Hiranandanis) and/or their employees shall not carry out any work upon the project site during the pendency of the complaint filed by Navlakh Umbre Paryavaran Vikas Parisar Sangh against them.

Against the said order, Hiranandanis and their employees had approached the Bombay High Court which stayed the order of the Magistrate, observing that the order amounted to an injunction which could not be passed by the Magistrate.

Aggrieved by the order passed by the High Court, Navlakh Umbre Paryavaran Vikas Parisar Sangh, filed two Special Leave Petitions in the Hon’ble Supreme Court of India bearing nos. 5259/2011 & 5317/2011 against the above orders passed by the Bombay High Court. The Hon’ble Supreme Court, vide its order dtd. 05.08.2011 has stayed the effect and operation of the orders passed by the Bombay High Court. It has also issued notices upon the Hiranandanis and its employees to file their replies to SLPs. Consequently, the order of the Magistrate prohibiting any work to be carried out on the project site is revived.

The case is due to come up in the Supreme Court for hearing after 2 weeks.
