Sankalp India Wins Case against Trademark infringement by Volunteering Travel Solutions aka Volunteering Solutions

Sankalp India volunteering which is providing international volunteer services in India under its program "Shake hands India Volunteer Program" managed by Puran Tours had been alleged of Trademark infringement by a New Delhi (India) based company "Volunteering Travel Solutions Pvt.Ltd." also know as "Volunteering Solutions". This case as a legal complaint was put up with WIPO (World Intellectual Property Organization) and was notified to Sankalp India, that the Trademark "Volunteering India" was a property of "Volunteering Travel Solutions Pvt.Ltd.", New Delhi run by Mr. Saurabh Sabarwal and the domain of Sankalp India " www.volunteeringindia.org " should be transferred to the Complainant (here Volunteering Travel Solutions Pvt. Ltd.").

After the complaint was filed with Sankalp India on 18th.May.2011, the organization took the case head-on and with the help of some active volunteers responded to WIPO with facts, figures and trademark rules. The Complainant (Volunteering Travel Solutions Pvt. Ltd.") with an intention to hijack Sankalp India's business and social activities wrongly accused Sankalp India of stealing their goodwill, which on the contrary did not exist. Sankalp India alleged that Volunteering Travel Solutions / Volunteering Solutions has been actively misguiding international volunteers by proxy review websites with fake postal addresses and providing false promises.

After one month of intensive response and supplement filing, the Panel at WIPO Ms.Harini Narayanswamy gave her judgment on 14th.July.2011 in-favour of Sankalp India, mentioning that the Complainant (Volunteering Travel Solutions Pvt.Ltd.") was not able to provide any evidence that the Trademark "Volunteering India" was owned by the complainant and failed to establish rights in the mark.

The company Volunteering Travel Solutions / Volunteering Solutions did not have anything that could prove except a few testimonials to sustain their rights on "Volunteering India" trademark.

Sankalp India won the case and the complaint was denied.

Domain www.VolunteeringIndia.org now remains with the rightful owner Sankalp India (managed by Puran Tours) headed by Mr. Pranay Udawat, Jaipur, Rajasthan (INDIA)
