Courtesy of South Florida Business Journal – July 21, 2010 -- TALLAHASSEE, FL - Attorney General Bill McCollum today announced that his office has filed lawsuits against three Florida companies, alleging the companies and their owners used deceptive and unfair practices that enticed consumers to spend hundreds of dollars to advertise their timeshares for resale. All lawsuits are seeking restitution for affected consumers as well as court orders prohibiting the companies from committing further violations of Florida law and reimbursement of costs and fees.

“With complaints about timeshare resales on the rise, my office will continue launching investigations, filing lawsuits, and obtaining whatever relief is available for victims of these scams,” said Attorney General McCollum.
These lawsuits bring the number of lawsuits filed by the Office of Attorney General against timeshare resale companies to a total of 10. Additionally, more than 60 companies have been investigated and 48 investigations are active, including the four with the subpoenas served yesterday.

The Attorney General’s Economic Crimes Division has been actively pursuing timeshare resellers as part of a statewide initiative that started in 2009. In furtherance of these efforts, the Attorney General has recently joined forces with the Federal Trade Commission, The Department of Agriculture and Consumer Services, and local law enforcement across the state, establishing a multi-agency taskforce to combat fraud within the timeshare resale industry. The office has already recovered more than $ 1.8 million in settlements for return to consumers. This year, the Attorney General’s Office has received more complaints regarding timeshare resale than any other single issue.

“Consumers are trying to make prudent financial decisions, but many timeshare resale companies are blatantly scamming people by promising sales or refunds and failing to provide services even after taking hefty upfront fees,” McCollum said in the news release.

Consumer’s who are considering listing their timeshare for sale or rent are encouraged to contact the Attorney General’s Office in the state where the telemarketer is located, to inquire whether or not specific companies have complaints reported against them. We’ve heard first-hand accounts from many Timeshare Financial Recovery clients, how they have been victimized not only once, but in most cases 3 and 4 times. We have heard of other companies that are promising to get the money back “with no up front fees” but they are just getting names and phone numbers that are being sold over and over again … putting unsuspecting victims on a list. We hear stories from timeshare owners paying $500 to $1500 to timeshare listing companies claiming to be resellers. The owners rarely hear from the companies once they pay upfront, and their name is sold to another con-artists. This practice of “reloading” needs to stop. “It is nearly impossible to stop these con-artists completely, because most of the time they simply close the company, and start up under a different name,” says and Attorney General Spokesperson.
In the past year, McCollum’s office has reached settlements with six other timeshare resale companies. It’s part of a concerted crackdown on timeshare resale companies that, in recent months, has involved allegations of potentially deceptive business practices and resulted in the subpoena of 17 companies.
