Commercial landlord's, their agents and lawyers, have traditionally commanded the high ground in commercial leasing negotiations. Anthony Dyson, learned this the hard way when he entered the commercial leasing profession as a Landlord’s agent in 1983. Toronto, Ontario, Canada October 20, 2011. For years, landlords have traditionally dominated the commercial leasing process. “However today, tenant take back the negotiating process” says Dyson, expert author, speaker, real estate consultant and broker.
" 30 years ago all brokers worked for the landlord and tenants never got a fair shake. Nowadays changes in legislation have leveled the playing field for tenants” he says.

Dyson says with some authority having worked the first five years of his almost three decades in commercial real estate as a Landlord’s agent “Landlords set up a system that worked for them using first class agents and attorneys which ensured that tenants usually got the short of the leasing stick. I remember agents I worked with coming back to the office boasting about how they had bested tenants including some who were attorneys themselves.”
Dyson says there is a simple 3-step process to leasing commercial space to the tenant’s maximum advantage.
“First, find the space and make sure it’s right for your company. This is usually the easiest step and many tenants do this themselves. But don’t be fooled that leasing commercial space is easy just because finding the space wasn’t difficult!
After you have found a few spaces, a letter of intent or offer to lease is negotiated. Dyson says “This is where they separate the men from the boys or the women from the girls in commercial leasing. This document is by far the most important and landlord’s and their agents have been able to download one time and ongoing hidden costs onto tenants in the past by preying on the tenant’s ignorance of the process. Even the most savvy negotiators get tricked by first class agent and mumbo jumbo leasing terminology. There are literally dozens of ways to lost money, many of which come later in the lease term. Now with access to a good tenant consultant the tables have been turned in the tenant’s favor. After all she is the buyer and can always walk away if she doesn’t get what she asks for”
Third, is the lease itself. If the letter of intent or offer to lease have been properly negotiated there should be little left for an attorney to do but go over the find details. If not well negotiated the tenant’s attorney will not be able to protect the tenant from these costs and onerous lease clauses.
He says this is an easy way for companies to cut leasing costs and avoid surprise bills as well as ensure that their space is properly constructed and not too hot or too cold because of faulty construction or equipment.
He points out that there are dozens of ways that a tenant consultant can reduce your rental costs and protect you against loss.
