U.S. Second Circuit Appellate Court Asked to Disqualify Attorney General Cuomo From Defending State Employees Accused of Illegal Conduct

New YORK ,New Jersey, Connecticut, New York, United States of America (Free-Press-Release.com) September 17, 2010 -- New York, NY. – Christine C. Anderson, a former staff attorney with the Departmental Disciplinary Committee of the New York Supreme Court First Department, is asking the US Court of Appeals to prohibit Attorney General Andrew Cuomo from continuing to represent certain state employees she has sued in US District Court for violating her rights.

Anderson maintains she has been denied her right to a fair trial by the actions of the Attorney General, who has defended the state employees she has sued. In her motion to the Second Circuit Appeals Court, Anderson states that while she has charged a number of state employees “with serious violations of law, the Attorney General stood before the jury defending these very same actions as proper and within the law.” She says the Attorney General has prejudiced her case since the “jurors could and likely did conclude that the State of New York supported fully the conduct of the defendants,” who are senior employees of the New York Unified Court System.

In announcing the filing of her motion, Anderson said, “All citizens are guaranteed the right to a fair trial. But, this simply cannot happen in a case like mine where I have been the victim of the illegal actions of state employees, who wind up being defended by Attorney General Cuomo. In fact, the Attorney General should bring his own action against these same employees. He certainly should not be allowed to defend them.”

Christine C. Anderson’s case currently before the Second Circuit Court of Appeals seeks to hold New York State officials liable for conspiring to operate a corrupt attorney disciplinary process, which she and others have found to be managed and controlled strictly by money, favoritism and cronyism. Ms. Anderson has sued for damages resulting from her unjust termination by the Departmental Disciplinary Committee and repeated violation of her Constitutional rights.

In bringing her action against the state employees, Anderson has sought to speak out against official corruption and malfeasance. She is engaged in a continuing effort to expose the fraud and corruption, which she has found throughout the lawyer grievance committees operated by the New York State court system.

supporting Christine C. Anderson’s motion. PCAC President John T. Whitely issued the following statement:

PCAC supports without reservation Christine C. Anderson’s dedicated efforts to hold New York State officials liable for conspiring to operate a corrupt attorney disciplinary process. Ms. Anderson’s litigation is part of an expanding court reform campaign as a growing list of persons and organizations including PCAC that continue to attack New York State’s corrupt attorney grievance. PCAC and others have detailed abuses by the grievance committees and officials, including concealment of evidence, obstruction of justice, sexual assault by attorneys, pilfering of estates by attorneys, abuse of power, fraud, conspiracy and repeated violations of Constitutional rights. PCAC supports Ms. Anderson’s motion to disqualify Attorney General Cuomo from representing the grievance committee personnel charged with repeated violations of fundamental Constitutional rights.

PCAC was established in 2007 by affiliated member organizations, including Litigation Recovery Trust (LRT), a New York based rights administration organization, and Integrity in the Courts, and Expose Corrupt Courts, two Internet blogs focused on judicial and attorney disciplinary processes and procedures. The objective of the PCAC is to replace the existing New York State Attorney Grievance Committees with a body controlled by non-attorneys. PCAC is in the process of completing a review process, prior to submitting draft legislation for consideration by the New York State Senate Judiciary Committee for the purpose of terminating and replacing the current disciplinary committee structure with citizen controlled bodies.

Headquartered in New York City, PCAC represents the first bar review mechanism in the United States established by non-attorneys. Since news of the formation of the PCAC was first made public, individual complainants have been submitting requests in growing numbers to the committee to review both past and current matters before the New York State grievance committees.
