It sounds outrageous and you’d think it would be illegal. Unlike race, religion, age, gender, etc., being unemployed is not a protected status subject to anti-discrimination laws.

Employment experts say they believe companies are increasingly interested only in applicants who already have a job. Some job postings include restrictions such as "unemployed candidates will not be considered" or "must be currently employed." Those explicit limitations have occasionally been removed from listings when an employer or recruiter is questioned by the media though.
It is not against the law for companies to exclude the unemployed when trying to fill positions. You would think such a thing would be illegal, right? Well, it’s not. Unlike race, religion, age, gender, etc., being unemployed is not a protected status subject to anti-discrimination laws.
Even if companies don't spell out in a job listing that they won't consider someone who currently doesn't have a job, experts say that unemployed applicants are typically ruled out.
This theme of ‘not hiring the unemployed’ has been happening forever.
Which is one of the many reasons why career coaches and professionals say it’s easier to find a job if you already have one.
So what is an unemployed job-seeker supposed to do with this information?
How can you work around “Unemployed Need Not Apply?”
The most obvious answer to that question is to not appear to be unemployed!!! I am not suggesting that you should to be dishonest or lie in any way.
However, rather than leaving a gap in your professional experience in your resume my advice is to position yourself as NOT being currently unemployed – but rather to use Self-Employment as your current position.
Self-employed consultants and business owners often discount the full range of skills they gain while running a business.
You will learn to:
•Communicate effectively
•Get organized and stay organized
•Reduce mind clutter and self sabotaging behavior
•Make smart decisions
•Create successful systems for your business
•Market your business effectively
•Be proactive and productive
These skills can propel you into higher paying positions with key employers.
Your job responsibilities should be listed in the same way as they are for any other full-time job you've held; focus on those responsibilities which best meet your career objective and quantify your achievements when possible.
Exemplify your self-starter attitude under the Qualifications section of your resume. Make sure to list any employability skills you have acquired or strengthened while you were self employed.
As a final indication of your commitment to the job you are seeking. Make sure that your cover letter or email addresses anticipated concerns of your potential employer. Make references to anything on your resume that may raise questions.
If you still own your own business, but are looking for full-time work, for example, make sure to let your employer know what your long-term professional goals are and how you intend to balance your roles at both businesses.
Don't apologize for being self-employed. Your resume and cover letter should present you as a credible and passionate professional. Focus on the positive experiences and skills you have acquired as a freelancer, and make sure to let the employer know how these will benefit the company if you are their chosen candidate.
Your bottom line results could be that you make more money, have more time to enjoy life, and love being self-employed!
