Waves of arrests at Occupy Wall Street have made the question more pertinent than ever: What should you do if arrested at a protest?
Georgia—Occupy protests have spread across the United States and the world: from New York to California, people are taking to the streets to protest what they see as unjust treatment of ordinary people by big corporations. Unfortunately, these protests have quite often violated health and safety regulations, which has led to arrests of protestors. How exactly should someone react if they’re arrested at a protest? What can they expect to experience? How does Georgia criminal defense work?
The process from arrest to release on bail should take about 24 hours. If you are arrested on a minor charge, you should be able to bond out without ever seeing a judge. If you are arrested on a major charge or even a felony, you should see a magistrate within one day. The police will usually ask you for basic biographical information and take your fingerprints and photograph. A court agency will interview you about your ties to the community to assess your bail. While you are not required to answer questions, accurate information speeds up the process. It is in your best interest to provide accurate biographical information to speed up your release, but do not offer any information related to your charge unless you are in the presence of your Atlanta criminal lawyer.
Your bail will be set at a “first appearance,” which will probably take place over closed circuit television. Try to hire an Atlanta criminal lawyer to present arguments related to your bail; while you will be provided a public defender, they are often overworked and underpaid and cannot always provide the best defense. Bail is related to factors including the size of your offense and the seriousness of your crime, from a minor property crime to a serious assault of a Georgia police officer.
