The IRS has prescribed specific requirements for individuals who need to obtain an ITIN. An ITIN is required if an individual is a resident or nonresident alien who does not have and cannot obtain a SSN, and meets any of the following conditions:
Files a U.S. income, withholding or gift tax return (e.g., IRS Forms 1040NR, 8288, 1042, etc.).
Claims tax treaty benefits under an applicable U.S. tax treaty (e.g., U.S.-Mexico Income Tax Treaty)
Is claimed as a dependent of a U.S. citizen on his or her U.S. tax return.
Is a spouse of a U.S. citizen who elects to file a joint U.S. tax return
Is claimed as an exemption by a spouse on U.S. tax return
Files a U.S. tax return only to claim a refund
