Texas resident, Johnny Partain, had no idea his hard won court victory and judgment, earned in July 2002, would become the prize of multiple illegal lawsuits sought against him as Hidalgo County Judges and Attorneys conspire to prevent collection and to collect that judgment for their own use. The law is no longer an issue as Judges assisted by plaintiff Attorneys order counter-judgments without notice, trials, or proper legal procedure. Mr. Partain has confronted the well-known corruption of Hidalgo County politics and found that the corruption is tolerated through all ranks of Texas government. A federal lawsuit against the State of Texas is imminent, as action is initiated for “Court Reform”.
Mr. Partain complained of the Judges’ and Attorneys’ abusive behavior through legal procedures for over 26 months to the Appeals Court of Texas, Texas Supreme Court, Texas State Bar, Texas Attorney General, Texas Governor’s Office, Hidalgo County District Attorneys Office, FBI, and United States Attorneys Office. His protests have been directed to other official offices more responsive or less embarrassed by the allegations of judicial impropriety. “Basically, judicial officials consider the assaults as more of an embarrassment which they may ignore and executive officers consider the assaults as being a breach of civil rights but not criminal meaning I am in this fight alone,” says Mr. Partain. Court Reform as opposed to Tort Reform may have prevented these assaults directly by holding judges criminally responsible for their transgressions.
Two implementations of Tort Reform in Texas reduced recovery of victim damages, but have not addressed the basic issue of frivolous lawsuits and judicial corruption in Texas Courts as has been lavished on this family. Court Reform better defines the duty of a court and directly provides for penal and civil damages against officials abusing their duty. Court Reform takes some of the burden of policing the court out of the discretion of the Court and off the shoulders of litigants that do not have interest in sustaining corruption in the court system. Court Reform forces Judges to follow existing laws to punish frivolous lawsuits and harassments. The assaults against this Texas family are a showcase of malicious behavior. In response to continuous and unsanctioned attacks against his family, Mr. Partain created Brokenlaw.com to use his damages to fuel a new wave of “COURT REFORM” in Texas through a federal counter-lawsuit against the State of Texas.
