JACKSONVILLE, FLORIDA - Have you ever heard of someone telling their employer (The company They work for) that he or she would like to file workers compensation because they were Hurt on the job, to then find out they have been terminated for wanting workers compensation? This seems as if you would only read it in a story or see it as a horror flick, but it has become a reality for a 29 year old Jacksonville Florida resident who lives from paycheck to paycheck like most other people.
On February 2, 2005 Jon called his place of employment and told his supervisor Beth Keller that he wanted to file for workers compensation, and as a result of him asking for assistance he was TERMINATED by James Francis, RETAIL DIRECTOR FOR RETAIL DETAIL MERCHANDISING. According to the Florida department Of Workers Compensation it’s illegal for a business like RETAIL DETAIL MERCHANDISING to terminate anyone for filing a legit workers compensation claim. The Law clearly states that a company can not terminate someone for filing workers compensation claim.
When RDM refused to offer assistance with filing a "LEGIT" workers compensation claim - he took Action by creating his own website titled "Retail Detail Merchandising Discriminated"

Besides creating this online website he posted his Complaint on several websites including RipOffReport, which happens to be one of the biggest and well known complaint websites. Shortly after Jon took these actions against a company that clearly violated the law he wound up getting a very threatening Internet email, an email that was of course from a lawyer
representing Retail Detail Merchandising. Jeffrey Koltun, from Kane & Koltun indicated that if the post's and websites were not removed and do he did not retract the statements within five (5) days of the date e-mail, He has been instructed to immediately file a lawsuit for apparently slander, without further notice.. How can you consider a website that tells the truth Slander. Slander is a spoken defamation and In order to prove defamation, you have to be able to prove that what was said or written about you was false. If the information is true, or if you consented to publication of the material, you will not have a case. However, you may bring a defamatory action if the comments are so reprehensible and false that they effect your reputation in the community or cast aspersions on you.
As of right now the case between the 29 year old and Retail Detail Merchandising seems to be up In the air, but Jon continues to say he will NOT remove this website and stands by everything That he said until his complaint is resolved.
