My mortgage was through Wells Fargo Mortgage Corporation. I fell behind on payments and my home fell in to foreclosure. I had an appraisal done so I could put my home on the market for sale which I did do. The appraisal came in at $300,000. At that time the mortgage principal was $209,000. My back payments amounted to $18,000.
Approximately 5 days after I put my house on the market for sale, I left for a two week vacation to be able to mentally deal with the situation a little better. Approximately March 5th. 2003 a kitchen fire took place. Nobody knows exactly what happened except that my grandchildren must have hit a burner on catching a pan of grease on fire. The fire did $15,000 worth of damage to the kitchen cabinets, walls, alarm system, electrical etc.I had a mental breakdown through all of this since I worked so diligently for a solid year to save my home from foreclosure. I could never get in touch with the right person at Wells Faro to accomplish anything. I would spend most days, no exageration, 10 and 12 hours a day faxing forbearance forms, income statements, etc., just to be told that they went to the wrong department and they would give me phone numbers that weren't even affiliated with their institution. Needless to say I ended up in the hospital. My insurance agent came out to access the damage and told me to get an estimate on what the repairs would cost. The estimate was mailed in and it took my agent from March until August to get in touch with the right person at Wells Fargo on how to handle the check since my home was already in the foreclosure stages. He stated that he has been in the insurance business for 20 some odd years and this is a quote, "I have never been so totally ignored." The insurance check was finally mailed to me in my name, my contractors name who did the estimate on the damages, and Wells Fargo. My contractor then phoned the insurance department of Wells Fargo to see how to proceed. He was told that he and I needed to sign the check and mail it to them which we did do that same day in August. My contractor was told to start the repairs and the check would be mailed to him.The check never came. On March 1st. of 2004, a Mortgage Company by the name of EMC Mortgage Corporation bought out my mortgage. On March 5th.,4 short days later, my home was sold at sheriff's sale to no other than EMC Mortgage. EMC bid $2,400. and won the bid.On March 23rd. after the sheriff's sale, I received the insurance check mailed from EMC Mortgage. It was the original check, never cashed, and Wells Fargo had held it for 8 months. Should this money not have been applied to my mortgage to stop the foreclosure or should it not have been mailed to me for repairs so I could have had the chance to sell my home since I had already had it on the market? In essence they beat me out of approximately $30,000 to $40,000. If you research the internet, both Wells Fargo and EMC are known for their predatory acts. Is EMC a back door to Wells Fargo? I feel that I was truly robbed of having the chance to sell my home or to save it.EMC got in touch with a local Real Estate Agent to offer me $500.00 to move within 30 days. I told him "No"!!! I was made homeless due to lender misconduct or lender fraud due to unethical practice by Wells Fargo Home Mortgae Corporation.
